All services are delivered based on the agreed scope, proposal, or quotation. Any additional requests outside the agreed scope may be subject to additional fees.

3. Engagement & Deliverables

Project timelines, deliverables, and milestones will be outlined in the proposal or agreement.

Timelines may vary depending on:

• Client responsiveness
• Availability of required materials
• Third-party platforms or tools

We will make reasonable efforts to meet agreed timelines but do not guarantee strict delivery dates unless explicitly stated.

4. Fees & Payment Terms

• Fees will be outlined in the quotation or agreement.
• Payment may be required upfront, by milestone, or on a recurring basis depending on the service.
• All payments must be made within the agreed timeframe stated in the invoice.

Late payments may result in:

• Suspension of services
• Delays in deliverables

All payments made are non-refundable unless otherwise agreed in writing.

5. No Guarantee of Results

While we apply industry best practices and data-driven strategies, we do not guarantee specific outcomes, including but not limited to:

• Search engine rankings
• Website traffic
• Leads, enquiries, or sales

Performance may be influenced by factors beyond our control, including market conditions, competition, and platform algorithm changes.

6. Client Responsibilities

The client agrees to:

• Provide accurate information and required materials in a timely manner
• Review and approve deliverables promptly
• Ensure all provided content complies with applicable laws and regulations

Delays in client response may affect timelines and results.

7. Intellectual Property

Upon full payment:

• Final approved deliverables (e.g. website, content, creatives) will belong to the client

Until full payment is received:

• All materials remain the property of Nex7gen Digital Pte. Ltd.

We reserve the right to showcase completed work in our portfolio unless otherwise agreed.

8. Third-Party Platforms

Our services may involve third-party platforms such as:

• Google Ads
• Meta (Facebook/Instagram)
• Content management systems (e.g. WordPress)

We are not responsible for:

• Changes in platform policies or algorithms
• Platform downtime or technical issues
• Account suspensions or restrictions imposed by third parties

9. Limitation of Liability

To the fullest extent permitted by law, Nex7gen Digital Pte. Ltd. shall not be liable for:

• Any indirect or consequential loss
• Loss of business, revenue, or profits
• Any damages arising from the use or inability to use our services

Our total liability shall not exceed the amount paid for the services in question.

10. Termination

Either party may terminate the engagement with written notice as agreed in the contract or proposal.

Upon termination:

• All outstanding fees become immediately payable
• Work completed up to the termination date will be billed accordingly

11. Confidentiality

Both parties agree to keep confidential any non-public, proprietary, or sensitive information obtained during the course of the engagement.

12. Amendments

We reserve the right to update or modify these Terms at any time. Updates will be published on our website.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Singapore.
